Terms of use for this website and for buying Selva Mail.
Scope
This website and Selva Mail are operated by ID49 Digital, LLC (“we”, “us”). These terms cover your use of the selva.run website and the purchase of Selva Mail. Your use of the software itself is governed by the license, which takes precedence where the two overlap.
The website
This site is provided as is. We try to keep it accurate, and in particular we audit the product claims on it against the shipped code. Competitor pricing is public list pricing at the time of writing, and vendors change their prices without telling us.
The cost calculator is an estimate. It uses published list prices and a model of AWS costs. It is a decision aid, not a quotation, and your actual AWS bill depends on your usage, your region and your architecture. Do not treat its output as a commitment from us or from Amazon.
Purchasing
Purchases are processed by Polar, and completing a purchase means you also accept Polar's terms. Prices are in US dollars. Taxes are applied where required and are shown at checkout.
Selva Mail is a one-time purchase. There is no subscription, and no recurring charge is made unless you actively choose to renew for continued email support. Your repository access and the updates published there are permanent regardless.
Refunds
14 days, no questions asked. Email hi@selva.run within 14 days of purchase and we refund you in full. The full terms are on the license page.
Your responsibilities
Selva Mail runs on your infrastructure and sends through your own Amazon SES account. You are responsible for:
- Your AWS account, its costs, and compliance with the AWS terms and the SES acceptable use policy.
- Obtaining SES production access, which is granted by Amazon and not by us.
- The lawfulness of the email you send, including consent, unsubscribe handling, and compliance with GDPR, CAN-SPAM, LGPD and any other regime applicable to you and your recipients.
- Securing your deployment, your credentials and your database.
We provide tooling that helps with several of these — double opt-in, automatic suppression, one-click unsubscribe, DKIM and DMARC support — but the obligations remain yours.
Acceptable use
You may not use Selva Mail to send unsolicited bulk email, to send to addresses you did not collect with consent, or for any unlawful purpose. Doing so also breaches Amazon's terms, and Amazon will act on it regardless of anything we say here.
Intellectual property
The Selva Mail source code, this website and its content are ours. Your rights in the software are those set out in the license. Selva CMS is released under an open-source license, and its terms are in its repository.
Liability
To the maximum extent permitted by applicable law, our total liability arising out of or relating to these terms is limited to the amount you paid us. We are not liable for indirect, incidental, special or consequential damages, including lost profits, lost data, or email that failed to deliver.
Nothing here limits liability that cannot lawfully be limited.
Changes
We may update these terms. Material changes will be reflected here, and the terms in force when you purchased continue to govern that purchase.
Governing law and contracting entity
The contracting entity is ID49 Digital, LLC, a Wyoming limited liability company, of 7345 W Sand Lake Rd, Ste 210, Office 8092, Orlando, FL 32819, United States. These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules.
